[your name] Claim number: [claim or case number] To [agency name]: I am appealing the determination dated [date of the denial notice] on my unemployment claim. I disagree with the decision for these reasons. I worked for [last employer]. [what actually happened]. I am asking that the determination be reversed and my benefits be paid. How to get it right
- Find the appeal deadline on the denial notice. In many states it is short (often 10 to 30 days), and missing it can end your claim.
- Keep claiming weekly benefits while you appeal. In most states you must continue to certify to be paid if you win.
- Stick to facts, dates and documents. Avoid arguing about the employer’s character.
- Gather the separation letter, pay stubs, emails and the names of any witnesses before the hearing.
- Many states have free help for appeals: legal aid or the agency’s own hearing office. Ask when you file.
Questions about this message
- How long do I have to appeal an unemployment denial?
- It depends on the state, and the date is printed on your determination notice. It is often between 10 and 30 days, so file as soon as you can.
- Do I have to keep filing weekly claims while I appeal?
- In most states, yes. Keep certifying each week so you can be paid for those weeks if the appeal succeeds.
- Do I need a lawyer to appeal?
- No. Many people appeal on their own. Legal aid offices often help with unemployment hearings for free.
- What happens after I file?
- Most states schedule a hearing, often by phone, where you and your employer can each explain and show documents. A decision follows in writing.
