About the job
The Office of the Utah Attorney General has an immediate opening for a complex litigation attorney to enforce consumer protection laws and to counsel the Utah Division of Consumer Protection. This includes investigating companies both large and small and bringing civil actions in state and federal courts. We bring cases alone and sometimes in collaboration with other state attorneys general and federal partners. We are looking for an attorney who is motivated to advocate on the public’s behalf to curb harmful business practices—whether by local actors or multinational industries—to redress past harm and to create positive change for Utahns. Our team operates in the fast-paced, meaningful, and challenging world of affirmative enforcement. Our work includes litigating to stop the opioid crisis, challenging unaffordable insulin prices, suing Ticketmaster over its sales practices, holding social media companies accountable for harming kids, driving Pornhub to bring down non-consensual and child pornography, combatting abuse against elders and other vulnerable populations, stopping false advertising, and halting Ponzi schemes. The Commercial Enforcement Division’s mission is to make Utah’s marketplace safe and fair by combating unlawful commercial activities and building trust in our economic landscape. We work collaboratively with our client agencies and federal and state partners to: protect consumers from deceptive and unfair business practices (the Consumer Section); stop the unlicensed and fraudulent sales of securities and commodities, and oversee the professional standards for real estate brokers, appraisers, and mortgage lenders (the Securities Real Estate Section); and regulate the professional standards for over thirty professions, from midwives to funeral services and nearly everything in between (the Professional Licensing Section). We are looking for a colleague who is a fantastic listener, writer, and communicator, is skilled in pre-trial discovery as well as trials, and has the talent and enthusiasm to lead and be part of a team. Duties and responsibilities Assist in setting and reaching the goals of the Attorney General. Act as litigation counsel for any case the Attorney General brings on behalf of the State, the public, or the Office’s clients—the Department of Commerce and its Divisions of Consumer Protection, Securities, Professional Licensing, Real Estate, Corporations and Commercial Code, and the Office of Artificial Intelligence Policy. Act as internal counsel for the Department of Commerce and its subparts including the Division of Consumer Protection. Conduct all levels of civil litigation from initial intake, through investigation, administrative proceedings, pleadings, expert and fact discovery, trial, appeal, and post-judgment. Mentor and train clerks, paralegals, and staff. Handle high-profile and complex cases. Build and maintain positive relationships with clients and colleagues. Negotiate resolution of complex, multi-party litigation. Communicate, write, and listen well. Draft legal briefs, contracts, and memoranda. Consult and advise clients and colleagues on complex issues of law and regulation. Present on topics at conferences and panels. Learn new skills and practice areas as needed. Potential travel to various events and courts in and outside of Utah.
